How to send a copyright notice or a counter-notice.

Send a copyright notice

Tobby respects intellectual property. Do not post content you do not have the right to post, including music, video, images or text owned by others. If you believe content on Tobby infringes your copyright, email tby@tobby.live with the subject "Copyright notice" and include:

  1. your physical or electronic signature;
  2. the work you say was infringed;
  3. the link or the live where the content is;
  4. your name, address, phone and email;
  5. a statement that you believe in good faith that the use is not authorized by the owner, its agent or the law; and
  6. a statement, under penalty of perjury, that the notice is accurate and that you are the owner or authorized to act for the owner.

The same rules are in the Terms.

Send a counter-notice

If we remove your content because of a notice, we will tell you. If you believe it was removed by mistake, email tby@tobby.live with the subject "Copyright notice", write "Counter-notice" in the first line, and include:

  1. your signature;
  2. the content removed and where it was;
  3. a statement under penalty of perjury that you believe in good faith that it was removed by mistake or misidentification;
  4. your name, address and phone; and
  5. your consent to the jurisdiction of the federal court for your address (or, outside the United States, of the Southern District of Florida) and to accept service from the person who sent the notice.

If the person who sent the notice does not file a court action within 10 to 14 business days after we send them your counter-notice, we may restore the content.

Repeat infringers

It is our policy to close the accounts of people who repeatedly infringe copyright. Sending a false notice can make you liable for damages.

Intimate images shared without consent

This is not a copyright matter, so it has its own process and its own deadline. Email tby@tobby.live with the subject "Take It Down". We act within 48 hours of a valid request. See Take It Down on the Support page for what to include.

Mandar un aviso de derechos de autor

Tobby respeta la propiedad intelectual. No publiques contenido que no tienes derecho a publicar, incluida música, video, imágenes o textos de otros. Si crees que un contenido de Tobby infringe tus derechos de autor, escribe a tby@tobby.live con el asunto "Aviso de derechos de autor" e incluye:

  1. tu firma física o electrónica;
  2. la obra que dices que se infringió;
  3. el enlace o el vivo donde está el contenido;
  4. tu nombre, dirección, teléfono y correo;
  5. una declaración de que crees de buena fe que el uso no está autorizado por el dueño, su agente o la ley; y
  6. una declaración, bajo pena de perjurio, de que el aviso es exacto y de que eres el dueño o estás autorizado para actuar por él.

Las mismas reglas están en los Términos.

Mandar una contranotificación

Si quitamos tu contenido por un aviso, te lo diremos. Si crees que se quitó por error, escribe a tby@tobby.live con el asunto "Aviso de derechos de autor", escribe "Contranotificación" en la primera línea e incluye:

  1. tu firma;
  2. el contenido quitado y dónde estaba;
  3. una declaración bajo pena de perjurio de que crees de buena fe que se quitó por error o por una identificación equivocada;
  4. tu nombre, dirección y teléfono; y
  5. tu consentimiento a la jurisdicción del tribunal federal de tu dirección (o, fuera de Estados Unidos, del Distrito Sur de Florida) y a aceptar la notificación de quien mandó el aviso.

Si quien mandó el aviso no presenta una demanda en un plazo de 10 a 14 días hábiles desde que le mandamos tu contranotificación, podemos restaurar el contenido.

Reincidentes

Nuestra política es cerrar las cuentas de quienes infringen derechos de autor de forma repetida. Mandar un aviso falso puede hacerte responsable de daños.

Imágenes íntimas compartidas sin permiso

Esto no es un tema de derechos de autor, así que tiene su propio proceso y su propio plazo. Escribe a tby@tobby.live con el asunto "Take It Down". Actuamos en un máximo de 48 horas desde una solicitud válida. Mira Take It Down en la página de Soporte para saber qué incluir.
